Elon Musk and Sam Altman Face Off in OpenAI Trial

Elon Musk and Sam Altman are heading into one of the most closely watched legal battles in the artificial intelligence world, as Musk’s long-running lawsuit against OpenAI finally moves to trial. The case begins with jury selection in Oakland, California, before U.S. District Judge Yvonne Gonzalez Rogers, with opening arguments expected shortly after. Musk, Altman, OpenAI president Greg Brockman, and Microsoft CEO Satya Nadella are all listed among the possible witnesses. At the center of the case is one major question: did OpenAI abandon the founding mission Musk says it was built on?
OpenAI was launched in 2015 as a nonprofit organization with the goal of developing artificial intelligence in a way that would benefit humanity, rather than simply chase profits. Musk, who helped co-found the company alongside Altman and Brockman, says he contributed tens of millions of dollars in its early years because he believed OpenAI would remain focused on that public-minded mission. His lawsuit accuses Altman, Brockman, and others of misleading him as the company shifted toward a for-profit structure and became one of the most powerful names in AI.
OpenAI strongly denies Musk’s accusations and argues that the lawsuit is more about competition than principle. The company says Musk knew about the possible for-profit direction and wanted to merge OpenAI with Tesla while becoming CEO himself. When that plan did not move forward, OpenAI claims Musk cut ties and later launched his own rival AI company, xAI, in 2023. OpenAI has described the lawsuit as an attempt to slow its growth and strengthen Musk’s own position in the fast-moving AI race.

The stakes are extremely high because OpenAI is now valued at about $852 billion and has become deeply connected to Microsoft, which invested billions into the company after Musk stopped funding it. Microsoft is also named as a defendant in the lawsuit. Musk is no longer mainly seeking damages for himself. Instead, he wants money directed toward OpenAI’s charitable arm and is also seeking Altman’s removal from OpenAI’s board. If Musk’s side succeeds, the court could potentially order major remedies, including forcing OpenAI to roll back parts of its for-profit transition.
The outcome could also affect OpenAI’s future business plans, including any possible IPO. OpenAI became a public benefit corporation in October 2025, with Microsoft receiving a 27 percent stake and OpenAI’s nonprofit arm receiving a stake valued at $130 billion. A major legal setback could complicate OpenAI’s ability to raise money, issue shares, and secure the massive computing power needed to build more advanced AI models. The trial is expected to run through mid-May, and while the jury’s verdict will be advisory, the final decision will rest with Judge Gonzalez Rogers.
The trial is also expected to reveal more about the complicated personal history between Musk and Altman. Evidence includes a February 2023 email exchange where Altman thanked Musk for helping OpenAI get started but said it hurt when Musk publicly attacked the company. Musk replied that he did not mean to be hurtful, but believed “the fate of civilization is at stake.” This trial is bigger than a feud between two famous tech leaders. It represents a larger debate over who should control artificial intelligence, how much profit should drive its development, and whether companies building powerful AI can stay loyal to their original promises.
